Piling Contractors insured had been appointed to provide piles to support foundations at the claimant’s new luxury house.
After cracking to the property occurred, experts were appointed who concluded that many of the piles were incapable of supporting the loads from the building structure. This meant that the foundations of the building settled and the building cracked.
In addition, a significant number of the key piles were not installed to the contractor’s design set and the expert’s report confirmed that the Piling Contractor’s negligence in installing the piles was therefore responsible for the damage that occurred.
The claim eventually settled at mediation with a cost of £125,000, with the majority of the cost eventually being picked up by the Insured’s Public Liability Insurers.
